SAFTalk Terms of Service

1. Acceptance of Terms
By creating an account, accessing, or using the SAFTalk website (saftalk.com), mobile application, or API (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms. If you do not agree to these Terms, you must not access or use the Service.
2. Description of Service
SAFTalk is an AI-powered research and compliance assistant designed for safety professionals. The Service utilizes Retrieval-Augmented Generation (RAG) technology to search specific databases, including the Occupational Safety and Health Administration (OSHA) standards (29 CFR 1910 and 1926), to provide citations, summaries, and answers to user queries.
IMPORTANT NOTICE: SAFTalk is a research tool. It is not a substitute for professional legal counsel, a Certified Safety Professional (CSP), or an official OSHA consultation.
3. Critical Health, Safety, and Legal Disclaimers
By using the Service, you explicitly acknowledge and agree to the following:
3.1 No Professional Advice
SAFTalk provides information based on pattern matching and data retrieval. The output generated by the Service does not constitute legal advice, medical advice, or certified engineering instructions. You should never ignore professional advice or delay in seeking it because of something you have read on the Service.
3.2 No Guarantee of Accuracy (AI Limitations)
While SAFTalk is geofenced to official government documentation to minimize errors, Artificial Intelligence is probabilistic, not deterministic. The Service may inadvertently generate incorrect information, outdated regulations, or "hallucinations" (plausible-sounding but incorrect answers). You are solely responsible for verifying all citations and regulations against the official Federal Register or OSHA.gov before taking action.
3.3 Not for Emergency Use
Do not use SAFTalk for immediate life-safety decisions, emergency response, or situations where incorrect information could result in death, personal injury, or severe environmental damage. In the event of a workplace emergency, call 911 or your local emergency services immediately.
3.4 Assumption of Risk
You assume full responsibility for the use of any information provided by the Service. SAFTalk and its affiliates are not liable for any OSHA citations, fines, stop-work orders, legal disputes, injuries, or damages resulting from your reliance on the Service.
4. User Accounts and Security
- Registration: You agree to provide accurate, current, and complete information during the registration process.
- Credentials: You are responsible for safeguarding your password. You agree not to disclose your password to any third party.
- Responsibility: You are solely responsible for any activity that occurs under your account. You must notify SAFTalk immediately of any breach of security or unauthorized use of your account.
5. License and Acceptable Use
5.1 Limited License
Subject to your compliance with these Terms, SAFTalk grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business or professional purposes.
5.2 Prohibited Restrictions
You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to discover the source code or underlying algorithms of the Service.
- Use the Service to develop a competing product or service.
- Use automated scripts, scrapers, or bots to access the Service without express written permission.
- Input sensitive Personal Identifiable Information (PII) or Protected Health Information (PHI) into the chat interface.
- Use the Service for any illegal or unauthorized purpose.
6. Subscription, Billing, and Cancellation
6.1 Free Tier
SAFTalk may offer a free tier (e.g., 10 queries/month). We reserve the right to modify the limitations of the free tier or discontinue it at any time without notice.
6.2 Paid Subscriptions
For paid plans, you agree to pay the fees indicated for that plan. Payments are billed in advance on a recurring basis (monthly or annually).
6.3 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. There are no refunds for partial months or unused service time.
6.4 Price Changes
SAFTalk reserves the right to adjust pricing for the Service or any components thereof in any manner and at any time. Any price changes will take effect following notice to you.
7. Intellectual Property
7.1 Our IP
The Service, including its "look and feel" (e.g., text, graphics, images, logos), proprietary algorithms, and software, is the exclusive property of SAFTalk and its licensors.
7.2 Your Data
You retain ownership of the queries you input into the Service. By using the Service, you grant SAFTalk a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your inputs solely for the purpose of providing and improving the Service (including training our AI models), subject to our Privacy Policy.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SAFTALK EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT: (I) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS; (II) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; OR (IV) THE QUALITY OF ANY INFORMATION PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SAFTALK, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR:
- (A) ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, COVER, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, REVENUE, GOODWILL, USE, OR CONTENT) HOWEVER CAUSED, UNDER ANY THEORY OF LIABILITY, INCLUDING, WITHOUT LIMITATION, CONTRACT, TORT, WARRANTY, NEGLIGENCE, OR OTHERWISE.
- (B) ANY DAMAGES ARISING FROM OSHA FINES, LEGAL JUDGMENTS, OR REGULATORY PENALTIES INCURRED BY THE USER.
- (C) ANY DAMAGES EXCEEDING THE GREATER OF FIFTY U.S. DOLLARS ($50) OR THE AMOUNT YOU PAID SAFTALK FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to defend, indemnify, and hold harmless SAFTalk and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (a) your use and access of the Service; (b) a breach of these Terms; or (c) safety decisions made by you based on output from the Service.
11. Modifications to the Service
We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that SAFTalk will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.
12. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of Texas, without regard to its conflict of law provisions.
Arbitration: Any dispute arising from these Terms or your use of the Service will be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. You agree to waive your right to a trial by jury or to participate in a class action.
